Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using the BandHQ mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Eligibility
You must be at least 13 years old to use BandHQ. If you are under the age of majority in your jurisdiction, you must have parental or legal guardian permission to use the Service, and your parent or guardian must agree to these Terms on your behalf where required by law.
3. Accounts
To access core features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security and confidentiality of your account login credentials.
- Accept sole responsibility for all activities, data transactions, and interactions that occur under your account.
4. Use of the Service
BandHQ is a mobile-first platform designed for managing songs, setlists, shows, chord charts, notes, documents, and band collaboration. You agree not to:
- Misuse the Service, disrupt its operational integrity, or attempt unauthorized access to its servers, networks, or connected accounts.
- Upload content or use the Service for any unlawful, harmful, or fraudulent purposes.
- Circumvent or bypass security features or limits placed on storage or features.
5. User Content and Ownership
You retain full ownership, copyrights, and intellectual property rights for any songs, notes, charts, audio files, documents, and other materials you upload or input into BandHQ ("User Content").
You grant BandHQ a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit, back up, and display your User Content solely to provide, support, and maintain the features of the Service for you and your band members. You represent and warrant that you own or have the necessary rights to use and upload all User Content.
6. Band Collaboration
BandHQ enables collaborative workspace sharing. Any User Content you share within a band profile—including song arrangements, keys, setlists, and schedule details—will be visible and editable by other authorized and invited members of that band. BandHQ is not responsible or liable for any actions, modifications, deletions, or disclosures of your shared content performed by other band members with whom you collaborate.
7. Subscriptions and Payments
BandHQ may offer paid subscription tiers or premium add-ons in the future. Subscription pricing, payment schedules, automatic renewal terms, and cancellation procedures will be clearly presented to you at the time of purchase. Transactions processed through the Apple App Store will also be subject to Apple's standard billing terms and policies.
8. Service Availability and Backups
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BandHQ makes no warranties or guarantees regarding uninterrupted operation, data availability, synchronization latency, or error-free performance during live events. While we design Show Mode for high-contrast stage stability, you are encouraged to maintain independent backups of all essential charts, setlist arrangements, and media assets.
9. Limitation of Liability
To the maximum extent permitted by applicable law, BandHQ and its owner, Parker VanderYacht, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of the Service. In no event shall our total aggregate liability exceed the amount paid by you to BandHQ during the twelve (12) months preceding the claim, or one hundred dollars ($100 USD), whichever is greater.
10. Termination
You may close and delete your account at any time through the application settings (**Settings** > **Account** > **Delete Account**). BandHQ reserves the right to suspend, terminate, or restrict your access to your account or the Service at any time, with or without notice, if we believe you have violated these Terms.
11. Privacy
Your use of BandHQ is also governed by our Privacy Policy, which details how we handle account data, media, and diagnostics. You can review the policy at our Privacy Policy Page.
12. Changes to Terms
We reserve the right to update or modify these Terms from time to time. We will indicate the revised date at the top of this page. Your continued use of the Service after any modifications constitute your agreement to be bound by the updated Terms.
13. Governing Law
These Terms and your use of the Service shall be governed by, and construed in accordance with, the laws of the State of Washington, United States, without regard to its conflict of law principles. Any legal actions arising under these Terms shall be resolved in the state or federal courts located in the State of Washington.
